Now that much of our personal information is exposed online, protecting privacy is more important than ever. If your personal information, private correspondence, or some humiliating video or photo has been published publicly, what can be done? In this article, attorney Michael Decker explains what the law says about privacy protection and what legal measures are available to those whose right to privacy has been violated.<\/p>\n

What is a VIOLATION OF PRIVACY?<\/strong><\/h4>\n

The Privacy Protection Law<\/a>, 1981-5571<\/a> is the dominant Israeli statute on privacy protection. In section 1, it states that a person shall not violate the privacy of another without his consent. A violation of privacy is defined as a serious violation that constitutes an infringement of a fundamental right, such as dignity and freedom.\"Privacy<\/p>\n

The purpose of the law is to protect every person’s right to privacy. However, deciding what is a violation of a fundamental right is not easy. In section 2 the law defines what constitutes a violation of privacy, and lists 11 cases that can constitute a violation of the right to privacy, among them:<\/p>\n

    \n
  1. Stalking or following a person, in a way that may harass him, or other harassment (section 1).<\/li>\n
  2. Prohibited listening by law (section 2).<\/li>\n
  3. Photographing a person when he is in the private domain (section 3).<\/li>\n<\/ol>\n

    The purpose of section 3 is to protect photographs that may harm or embarrass a person. This section grew particularly important at present. Today, everyone walks around with their smartphones and can take a picture of anything, at any given moment. One should be aware that if you take a picture of a person when he is alone or at home without consent, this constitutes an invasion of privacy.<\/p>\n

      \n
    1. Copying the content of a letter or other writing that is not intended for publication (Section 5)<\/li>\n<\/ol>\n

      This is also a common way to violate privacy – if you publish content without the author’s permission.<\/p>\n

        \n
      1. The publication of matter concerning aa person’s personal life, including his sexual past, or his state of health, or his behavior in private (section 11).<\/li>\n<\/ol>\n

        COMPENSATION WITHOUT PROOF OF DAMAGE<\/strong><\/h4>\n

        Privacy law is similar to defamation law, in that the victim can file a civil claim for compensation without proof of damage. In such a case, Section 29a.(b)(1) of the law states that the court may compel the defendant to pay the victim compensation not exceeding NIS 50,000. If it is established that the violation of privacy was done with the intent to harm, the court may oblige the defendant to pay double compensation to the victim.<\/p>\n

        VIOLATION OF PRIVACY – A CRIMINAL OFFENSE<\/strong><\/h4>\n

        Violation of privacy can be a criminal offense in addition to being a civil one. The criminal penalty is 5 years in prison.<\/p>\n

        PROTECTIONS AND EXEMPTIONS<\/strong><\/h4>\n

        Chapter 3 of the law deals with legal defenses. In section 18, the law outlines situations in which there will be no liability due to invasion of privacy in a criminal or civil trial.<\/p>\n

        For example, 19. (a) establishes an exemption, where a person cannot be held liable for an act that he is authorized to do by other law.<\/p>\n

        The protections in the Privacy Protection Law are similar to the protections in Defamation Law. For example, if a violation of privacy occurred in circumstances where the offender had a legal, moral, social or professional obligation to do so. Another example is a case where the injury was done to protect a legitimate personal interest of the offender.<\/p>\n

        EXAMPLES OF INVASION OF PRIVACY<\/strong><\/h4>\n

        Examples of Privacy Violations<\/strong><\/h4>\n

        A common example of a privacy violation is the publication of a photograph of a person without their permission.<\/p>\n

        The law prohibits photographing a person in a private setting, meaning in places like their private home, a hotel, public restrooms, etc.<\/p>\n

        Moreover, the law also forbids publishing a photograph of a person’s presence in public under circumstances where the publication may humiliate or degrade them.<\/p>\n

        In the case of John Doe v. Ariel Semel<\/a> (Civil Case 21945-07-14), the court dealt with this exact issue. The plaintiff filed a lawsuit against the defendants concerning the publication of his nude photograph. The plaintiff claimed the defendant violated him under\u00a0 the Protection of Privacy Law and the Defamation Law.<\/p>\n

        The court accepted the lawsuit, ruling that publishing the plaintiff’s photographs, including a full nude and other partially nude images, constituted humiliation and degradation as per Section 2(4) of the Protection of Privacy Law. The court held that although the photos might be received indifferently by some of the public, a significant portion would view them and the plaintiff with contempt and disapproval. Additionally, it was determined that although the plaintiff had posed privately for these photographs around 30 years ago, this did not mean he had waived his privacy or permitted the publication of these photos.<\/p>\n

        Another example of a privacy violation can be found in the case of Yosef Mizrahi v. Walla <\/a>Communications Ltd. (Civil Case 8419-03-15).<\/p>\n

        The lawsuit was filed because of a publication of revealing photographs of the plaintiff on the balcony of his apartment and the subsequent publication of the images on the Walla website and social networks. The second defendant, a paparazzi photographer, took the pictures and sold them to Walla for a fee.<\/p>\n

        The court ruled that under the circumstances, the plaintiff was photographed in a private setting, constituting an invasion of his privacy under the Protection of Privacy Law. The court found that the photographs and the published details related to the plaintiff’s private life and behavior in private settings, and the images were likely to humiliate or degrade him.<\/p>\n

        Another example of a privacy violation is the disclosure of a person’s personal details. For instance, in Civil Case 23789-02-11, the court awarded 35,000 shekels in damages because the defendant\u2014a woman the plaintiff knew\u2014revealed to his wife that he was the father of her child (alleging “sperm theft,” of which he claimed to be a victim). The defendant harassed the plaintiff by sending numerous text messages, deliberately trying to disrupt his marriage.<\/p>\n

        The court ruled that the text messages constituted severe harassment and a violation of the plaintiff’s privacy.<\/p>\n
